Monsignor Dale Fushek had been accused of sexually inappropriate behavior in the past and in April of 2004 he was demoted by the newly installed Phoenix Diocese Bishop Olmstead. In January of 2005 a lawsuit was filed in Maricopa County Superior Court alleging that Fr. Fushek, then pastor of the St. Timothy's Catholic Parish in Mesa, Arizona witnessed another priest sodomize a teen and allegedly did nothing to stop or intervene. On November 21, 2005, Dale Fushek was arrested in Maricopa County and was charged with 10 misdemeanor counts related to inappropriate sexual behavior with minors and adults.
