L'ordine del draft è costituito semplicemente invertendo l'ordine di come si è conclusa la [[National Football League 2008|stagione regolare 2008]], quindi dalla squadra che aveva ottenuto meno vittorie a quella con più vittorie; tranne per le ultime due scelte (31ª e 32ª) che sono state assegnate rispettivamente alla perdente e alla vincente del [[Super Bowl XLIII]].

In caso di parità di vittorie si è tenuto conto come prima cosa della difficoltà del calendario che le squadre con lo stesso numero di vittorie hanno dovuto affrontare. In caso di ulteriore parità si è tenuto conto del numero delle vittorie raggiunte all'interno della propria ''division'' o ''conference''. In caso di ulteriore parità, la decisione è stata presa con il lancio della monetina.
