He was renominated on [[January 7]], [[2003]], to replace [[James L. Buckley]]. His nomination was approved by the Judiciary Committee by a vote of 16 to three, with Senators [[Richard Durbin]], [[Charles Schumer]] and [[Ted Kennedy]] opposing. However, he was approved by the Senate under [[unanimous consent]] and he received his [[commission]] on [[June 2]], [[2003]].
